Is Sports Betting Legal in South Carolina?
South Carolina has not yet joined the list of legal sports betting states in the US. Online, retail, and mobile sports betting is completely unregulated in the state of South Carolina. The South Carolina Code of Law explicitly forbids all forms of gambling in SC including state lotteries. The chapter on the activity, entitled Gambling and Lotteries, falls under Crimes and Offenses. January 2024 – South Carolina legislators reconvene for a legislative session that may see a sports betting bill introduced, while the Senate Ways and Means Committee is scheduled to review HB3749.
December 2023 – Scientific Games, an online casino games developer, launches a Players’ Club Rewards program associated with the South Carolina Education Lottery.
November 2023 – As the 30th Fall Steeplechase approached, there were new calls for regulated South Carolina sportsbooks.
South Carolina Senate – Bills and Motions
South Carolina gambling laws state that any attempt to introduce sports betting in South Carolina would require an alteration to the state’s code of law. Although sports gambling in South Carolina is still unregulated, there have been many attempts to introduce it. Ever since the Supreme Court repealed the Professional and Amateur Sports Protection Act, lawmakers have introduced bills to try and launch sports gambling in SC.
2023
- House Bill 3749 – This is the most recent sports betting bill attempted. It would alter the code of law and introduce retail sports betting and online sports betting in South Carolina. There was some positivity around the bill as it follows North Carolina’s introduction of sports betting. However, the bill sat for eight months after it was referred to the Ways and Means Committee.
2022
- House Bill 5277 – This bill looked to amend the state’s code of law to make South Carolina another one of the legal sports betting states in America. It was referred to the House Judiciary Committee where it failed to progress.
- House Joint Resolution 3095 & Senate Joint Resolution 0068 – Similar to HB 5277, this aimed to introduce interactive sports wagering but this time through altering the constitution.
- Senate Joint Resolution 53 – The Senate attempted to pass a bill previously introduced in 2019 as SJR71. Both bills asked legislators to form a Gambling Study Committee which would have examined issues related to regulating sports gambling in SC. It could also help decide how the tax revenue generated from South Carolinians gambling can be directed. They both died with the Senate Judiciary Committee.
2020
- House Joint Resolution 3395 & Senate Joint Resolution 98 – These two bills were linked in their aim to allow gambling and gaming activities in South Carolina. The aim was to amend the state’s constitution to allow a general assembly to decide on South Carolina gambling laws. It died with the House and the Senate Judiciary Committee
2019
- Senate Joint Resolution 71 – This bill was attempted again in 2022 as SJR53. The two bills’ texts are essentially the same. SJR71 asked for a “comprehensive analysis of the costs and benefits legalized gambling may produce for the state.” This analysis will help pave the way for more relaxed South Carolina gambling laws.
2018
- House Joint Resolution 3409 & Senate Joint Resolution 57 – These associated bills aimed to amend The Constitution Of South Carolina, 1895 to allow for the regulation of South Carolina gambling and sports betting. This bill died with the Judiciary Committee.
